Terms and Conditions

1. Introduction

Welcome to LawWiseAge! These Terms and Conditions govern the legal relationship between our senior legal services firm and our clients. They are an essential component of every service agreement and apply to all types of services and solutions offered in the area of legal assistance for seniors.

2. Client Relationship

2.1. Establishment – A client relationship is established through the express acceptance of an engagement by LawWiseAge. An initial inquiry or consultation does not yet establish a client relationship.
2.2. Duty to Cooperate – The client undertakes to provide all information and documents relevant to their legal matters completely and truthfully, and to inform LawWiseAge about all relevant developments regarding their personal and financial situation that could affect our services.
2.3. Scope of Services – The specific service obligation arises from the individual service agreement. Unless expressly agreed otherwise, the services do not include specialized services that require external providers.
2.4. Digital Communication – The client agrees to communication via email and other electronic means, unless otherwise agreed in writing.

3. Fees and Billing

3.1. Fee Agreement – Unless otherwise agreed, fees are calculated based on the selected service package plus additional services and applicable taxes.
3.2. Deposit – LawWiseAge is entitled to request a reasonable deposit for the reservation and provision of services. The commencement or continuation of services may be made dependent on the payment of a deposit.
3.3. Invoicing – Invoicing is generally carried out monthly or according to agreed payment schedules. Invoices are payable within 14 days of the invoice date without deduction.
3.4. Additional Expenses – In addition to regular fees, necessary expenses such as court fees, filing fees, expert witness costs, and travel expenses may be billed separately.

4. Liability and Warranty

4.1. Limitation of Liability

  • LawWiseAge is liable for damages only in cases of intent and gross negligence.
  • Liability for slight negligence is limited to an amount of CHF 1,000,000 per case of damage.
  • This limitation of liability does not apply to personal injury or in cases of mandatory statutory liability.
    4.2. Limitation Period – Claims for damages against LawWiseAge expire within one year from the time the client became aware of the circumstances giving rise to the claim or should have become aware without gross negligence.

5. Confidentiality

5.1. Confidentiality – LawWiseAge is committed to strict confidentiality regarding all information and personal details that become known in the course of the client relationship.
5.2. Reference Naming – The client agrees that LawWiseAge may name them or their family as a reference, unless expressly agreed otherwise. This does not include specific details about the client's legal matters or personal strategy.
5.3. Data Protection – The processing of personal data is carried out in accordance with our separate Privacy Policy, which is an essential component of these Terms and Conditions.

6. Termination of Client Relationship

6.1. Right of Termination – The client relationship can be terminated by both the client and LawWiseAge with a notice period of 30 days, unless otherwise specified in the service agreement. In case of significant changes in requirements or services, a different notice period may be agreed.
6.2. Final Invoice – After termination of the client relationship, LawWiseAge will prepare a final invoice for services and expenses not yet billed. Advance payments will be credited in accordance with our refund policy.

7. Refund Policy

LawWiseAge is committed to fair and transparent billing practices. Our refund policy takes into account circumstances in which prepaid services could not be utilized:

  • Initial Consultation Fee – For all senior legal services, there is a non-refundable initial consultation fee of CHF 250 to cover preliminary assessment and administrative setup.
  • Cancellation by the Client – For service cancellations where work has already begun, a pro-rated refund will be issued based on the percentage of work completed, less administrative fees. For document preparation services, no refund is available once drafts have been presented to the client.
  • Temporary Service Suspension – Clients may suspend certain ongoing services for a period of up to 2 months without completely terminating the contract, provided this is communicated in writing at least 14 days in advance. Monthly retainer fees will be reduced by 50% during this period.
  • Service Adjustments – Switching to a lower service package may involve an adjustment fee and requires notice of at least 30 days. Upgrades can be made at any time without additional fees.
  • Service Interruptions – For service interruptions caused by LawWiseAge that last more than 48 hours, clients are entitled to a pro-rated fee waiver for the outage period plus an additional credit of 5% of the monthly service fee as compensation.
  • Force Majeure – In case of interruptions due to force majeure (natural disasters, pandemics, etc.), LawWiseAge will endeavor to find alternative solutions without being obligated to provide refunds.

All refund requests must be submitted in writing to [email protected]. Processing of refunds typically takes 7-10 business days from the date of the approved request.

8. Compliance

8.1. Business Ethics – LawWiseAge is committed to complying with all applicable regulations in the field of legal services for seniors. The client agrees to cooperate with necessary verification measures and to provide required information and documents, if applicable.
8.2. Conflicts of Interest – LawWiseAge reserves the right to decline or terminate client relationships if conflicts of interest exist or arise during the business relationship.

9. Final Provisions

9.1. Applicable Law – The client relationship and all associated claims are exclusively subject to Swiss law.
9.2. Jurisdiction – The place of jurisdiction for all disputes arising from or in connection with the client relationship is, to the extent legally permissible, Zurich, Switzerland.
